TERMS AND CONDITIONS OF QUOTATION

1 VALIDITY AND ACCEPTANCE
1.1 This quotation is valid for one month from the date of submission. Subject to clause 5.1, work will only proceed on written acceptance of the quote.
1.2 Any and all agreements concluded between Urgent engineering 1969 Ltd and the client shall be made in writing. Oral agreements shall not be valid unless recorded in written form.
1.3 Urgent Engineering 1969 Ltd may cancel quotation, by notifying the client in writing, at any time prior to commencing work.
1.4 Any and all cancellations may not be made once acceptance of the quotation has been received. It is the client’s responsibility to ensure the quotation is correct and accurate at the time of acceptance.
2 VARIATIONS
2.1 Any variation to this quotation (post acceptance) must be made in writing and is at the discretion of Urgent Engineering 1969 Ltd to be declined.
3 PAYMENT, INTEREST AND RETENTIONS
3.1 The invoice amount shall match the agreed quotation amount (unless previously agreed by the client in writing).
3.2 The client must pay Urgent Engineering 1969 Ltd the invoice amount in full before the 20th of the following month.
3.3 Urgent Engineering reserves the right to charge interest on all overdue payments. The interest rate shall be the bank of ANZ indicator lending rate plus 5% per annum. Interest shall be calculated on a daily basis.
3.4 The client is not entitled to deduct, set off or retain any amounts or withhold retentions from payments, unless otherwise specified in this quotation.
3.5 Withholding payment will result in all current and future works being put on hold until the outstanding amount has been paid in full.
3.6 Continued late payments may result in the client’s account being cancelled entirely.
4 CREDIT / CASH SALES
4.1 This quotation is not an offer of credit. Urgent Engineering may require the client to satisfy credit requirements and open an account with us before commencement of any work. Should you wish to apply for a credit account, please advise us and we will send you the appropriate application and a copy of our terms.
4.2 For all cash sales, payment is required before pick-up or organisation of delivery.
5 DELIVERY
5.1 The delivery time stated in this quote is an approximation only. Urgent Engineering 1969 Ltd will try their best to meet deadlines and delivery dates but unforeseen circumstances may affect this. Any delays in completing the job will be clearly and promptly communicated with the client in writing.
5.2 If the commencement of work is dependent on the client supplying parts or machinery, the estimated time to the complete the job will not begin until Urgent Engineering 1969 Ltd has all parts and machinery on site to be able to start the job.
5.3 In the event of any damages or defects during delivery please refer to separate document – “Limitation Period for Claims and Defects”
6 DOCUMENTS
6.1 We reserve title to and copyright of any illustrations, drawings, calculations and other documents; they may not be made accessible to third parties without our express written consent. Such documents shall be used solely for the purpose of client proof and manufacture. Such documents shall be treated as confidential and not be disclosed to third parties.
6.2 Prior to Urgent Engineering 1969 Ltd commencing work, the client shall review the texts, drawings and other documents and information provided to determine whether they are conclusive and correct, and shall promptly report to us, and obtain clarification of any errors or discrepancies detected. The client shall bear the consequences from having failed to conduct such reviews.
